By purchasing a BMWTrueNorth membership, you hereby agree to adhere to the following terms and conditions.

1.1 Being a BMWTrueNorth member is non-transferable and is only available to persons over the age of 18. The membership and benefits cannot be used by anyone apart from the individual named on the card. The length of the membership is for 12 months, starting in March of one year until the March of the following year. Unless otherwise noted on the bmwtn website.

1.2 The BMWTrueNorth membership card is not a payment card nor is it proof of creditworthiness and attempts to use it as such could constitute fraud.

1.3 By becoming a member, you accept registration and processing of personal information by BMWTrueNorth in accordance with prevailing legislation and these membership terms and conditions. BMWTrueNorth is responsible for processing the personal information a member agrees to provide. Members’ postal address, e-mail address, and mobile number may be used to send you information and offers within the framework of prevailing Ontario laws and regulations.

1.4 Members have the right to inspect or correct their personal information. Members can withdraw consent for allowing BMWTrueNorth to register and process their personal information. Withdrawal of consent will be treated as termination of membership of BMWTrueNorth, see clause 1.9.

1.5 A membership card will be issued as proof of membership. Membership cards will only be issued to residents of Canada. In order to register bonus points and to receive personal benefits, members are personally responsible for presenting their membership card at BMWTrueNorth events.

1.6 In the event of misuse of a membership card or bonus program, BMWTrueNorth reserves the right to terminate the member(s) in question from the club, upon which the club member will be notified, and the card will be considered invalid from that day forth. Such misuse may include, but is not limited to, behaviour which is troublesome or shows a lack of respect towards the staff, partners, sponsors, fellow club members, criminal action or actions, which are generally perceived to be immoral, unethical or contrary to these membership terms and conditions. If your membership is terminated for violating any of the clubs rules, you will not be eligible for a refund of your Membership Fee.

1.7 BMWTrueNorth reserves the right to terminate the club within a six-month notice period to members. Any such notice will be sent by e-mail, or there will be a notice on the BMWTrueNorth website.

1.8 Should BMWTrueNorth have to be discontinued due to conditions pertaining to legislation, a court decision or a prohibition by Canada’s public authorities, BMWTrueNorth will not be responsible for any losses to the individual member, which may ensue from this winding down of operations. BMWTrueNorth will, as far as possible, attempt to inform the individual member quickly if circumstances described under this point, should arise.

1.9 Members can cancel their membership at any time. A cancellation must be in writing and sent to info@bmwtn.com. Cancellation will take immediate effect from the date on which BMWTrueNorth receives notice of cancellation. Cancellation of membership means that you can no longer use the card and must be returned to BMWTrueNorth or destroyed by the card holder. There will also be no refund of the Membership Fee upon cancellation.

1.10 BMWTrueNorth is free to unilaterally change the membership terms and conditions without giving further notice to the individual member. Such changes will, unless otherwise stated, take immediate effect. BMWTrueNorth will publish changes to the terms and conditions on its website, but members are responsible for keeping themselves updated in relation to any changes to the terms and conditions. BMWTrueNorth will notify members via its monthly newsletter of any changes in the terms and conditions whenever possible.

1.11 BMWTrueNorth or any entity associated with BMWTrueNorth shall not be held responsible for any disputes that may occur between the cardholder and/or any club members and/or sponsors.

1.12 The cardholder agrees that she/he will defend and indemnify of BMWTrueNorth or any entity associated with TrueNorthEG, its directors, officers, employees and agents (collectively ‘the indemnified parties’) against and hold each indemnified party harmless from all liabilities, damages, losses, claims, suits, judgments, costs and expenses (including reasonable attorney’s fees) for injury to or death of any person or damage to or destruction of any property arising out of the participation of a club event by the cardholder or any guests or any person in said event at the behest of the cardholder, except that such indemnification shall not extend to acts of gross negligence or willful misconduct by the indemnified parties.
